What is a Right to Work check and how can technology help?

Right to Work (RtW) checks are a legal requirement for anyone wanting to work in the UK. It is illegal to hire someone who does not have a valid right to work in the UK.

The uCheck Right to Work service offers a straightforward platform for employers to verify the identity of all applicants and confirm they are eligible to work in the UK.

Choose the method that works best for you and your applicants:

Right to Work and Digital Right to Work FAQs

You should never make assumptions about a person’s eligibility to work in the UK or their immigration status. From 1 October 2026 the Right to Work Scheme covers all employees, as well as workers under a worker’s contract, individual sub-contractors, and people engaged through online matching services. In some contractual arrangements, liability can also extend to others in the chain (extended liability).

With our Digital Right to Work check process, employers send an application link to their candidates to complete remotely. Candidates then capture their evidence and take a selfie to confirm their identity. Employers will then receive the results back into the uCheck platform. The process can be as fast as two minutes if the applicant completes the process as soon as it appears. However, it can take longer if the applicant waits to complete the process or if a human expert needs to review the submission.

Digital Identity Verification allows applicants to digitally prove their identity by sharing identity documents (IDs)which are then verified in partnership with our sister-service, TrustID. Digital ID can then be used to support Right to Work checks, or in conjunction with uCheck’s DBS checking service.

You can invite all candidates to complete a Right to Work check through uCheck. For fully remote checks, eligible candidates need to have a British or Irish passport or passport card which is up to six months expired. We can also accept share codes from non-UK citizens who have an eVisa account. For these candidates, the only follow up is to ensure that the person on whom the Right to Work check was completed is the same person as turns up to work.

For anyone relying on other evidence from List A or List B, please note that, whilst our service can validate the evidence, the employer will still need to see an original copy of the documents before the applicant begins work.

With our Right to Work service, you will receive a clear report which is in line with the Home Office requirements for a DSVP. The result will show as PASSED or FAILED and any failed reports will include details of the failed checks as well as notes giving further details around reasons for the failure.

At uCheck, we offer a straightforward, pay-as-you-go Right to Work service which supports robust compliance for all your candidates. We are powered by the UK’s leading Right to Work provider and our team are on hand if you have questions or need support.
