The answer depends on the assessor or tutor’s specific role, and who they work with. Read on to find out everything you need to know about DBS Checks for NVQ assessors.
DBS Check eligibility
There are three different levels of DBS Check: Basic, Standard and Enhanced.
To have a Standard or Enhanced DBS Check, an employee must meet specific eligibility criteria. To find out more about the eligibility criteria, see the government’s guidance.
There are no eligibility requirements for a Basic Check. Anyone aged 16 or over can have one, so employees who aren’t eligible for a Standard or Enhanced Check could have this type of check.
To determine an employee’s eligibility for a DBS Check, you need to think about the specific role they’ll be doing. Below, we’ll look at three different scenarios where you might consider applying for DBS Checks for NVQ assessors, and explain whether they’d be eligible.
Assessors and tutors working with participants aged 18 or over
Participants on NVQs, training courses or apprenticeships who are aged 18 or over are considered adults for DBS Checking purposes.
This is true of anyone aged 18 or over, regardless of whether they are in education, employment or not in work.
Because of this, assessors or tutors carrying out training or assessments for these participants are not eligible for a Standard or Enhanced DBS Check. This is the case whether the training or assessment takes place in the participants’ workplace or offsite.
If you wanted to obtain a DBS Check for NVQ assessors or tutors in this scenario, they would only be eligible for a Basic DBS Check.
Assessors and tutors working with employed participants aged 16 or 17
Anyone aged 16 or 17 who is employed is considered an adult for DBS Checking purposes.
Again, this means that assessors or tutors working with these participants on NVQs, training courses or apprenticeships related to their employment are not eligible for a Standard or Enhanced DBS Check. This is the case whether the training and/or assessment happens in the workplace or offsite.
Again, DBS Checks for NVQ assessors or tutors in this scenario would be limited to Basic Checks.
Assessors and tutors working with participants aged 16 or 17 who are not in work
Anyone aged 16 or 17 who is not in employment is considered a child for DBS Checking purposes.
Tutors or assessors carrying out training or assessment for these participants, either in the workplace or offsite, are carrying out either:
- Regulated activity with children, which would qualify them for an Enhanced DBS Check with a check of the children’s barred list; or
- Work with children, which would qualify them for an Enhanced DBS Check without a barred list check
The tutor or assessor would be carrying out regulated activity if they do the training or assessment in question frequently (three or more times in a 30-day period) and unsupervised. Otherwise, they would be classed as doing work with children.
